Copyright & Media

The legal framework for the protection of authors, composers, artists, and cultural industries under the Copyright Act, 1957.

Statutory Framework

The Copyright Act, 1957

The law of copyright provides a robust legal framework protecting the creative manifestations of traditional beneficiaries and modern digital entities alike.

We advise on the definitions of categories, broadcasting rights, terms of copyright, and assignment mechanisms as structured by the Copyright Office and Board.

Economic Rights

Registration Paradigm

While protection is automatic upon the creation of a work, registration remains voluntary in India. However, registered ownership (under section 45) provides undeniable evidentiary value.

Registration solidifies economic and moral rights, establishing a proactive baseline against infringement across platforms, distribution networks, and media channels.

Execution

Registration Procedure

We execute copyright registration with zero margin for error via the Copyright Office in New Delhi.

Step 1: Application Filing

Submission of Form-IV alongside the requisite statutory fee and four exact copies of the subject work to the Copyright Office.

Step 2: Formal Examination

Upon generation of the filing receipt, the work undergoes a statutory mandatory waiting period and formal examination process by the registry.

Step 3: Defect Office Action

Communication of defects and discrepancies. We handle the drafting of technical and legal responses to clear all registrar requisitions.

Step 4: Grant & Certificate Issuance

Registration finalized and entered into the Register of Copyrights, followed by the issuance of the formal Certificate.
